A. Acceptance of Terms

Welcome to WeRead. By accessing or using our website, mobile application, or any services we provide (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service constitutes your acceptance of these Terms and any future modifications.

These Terms constitute a legally binding agreement between you ("you," "your," or "User") and WeRead ("we," "us," or "our"). You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

Please read these Terms carefully, along with our Privacy Policy and Cookies & Tracking Policy, before using our Service.

B. Description of Service

WeRead is a parent-focused reading support tool that uses artificial intelligence to generate age-appropriate questions for children's books. Our Service is designed to help parents and guardians create more meaningful reading experiences with their children.

Our Service includes, but is not limited to:

  • Book scanning and identification using ISBN or barcode numbers
  • AI-generated reading comprehension questions tailored to specific age ranges
  • Vocabulary priming suggestions
  • Pre-reading prediction prompts
  • Dialogic reading prompts to encourage conversation
  • Reading session tracking and history
  • Personalized question difficulty based on your child's age

WeRead is intended exclusively for use by adults aged 18 and older, specifically parents and guardians. The Service is not designed for, nor should it be used directly by, children under 13.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you.

C. User Responsibilities

By using WeRead, you agree to the following responsibilities:

1. Age Requirements

You must be at least 18 years old to create an account and use the Service. You represent and warrant that all information you provide is accurate and that you meet this age requirement.

2. Lawful Use Only

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

  • Violate any local, state, national, or international law or regulation
  • Infringe upon or violate our intellectual property rights or the rights of others
  • Transmit any harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems, servers, or networks
  • Use automated tools (bots, scrapers, crawlers) to access the Service without permission
  • Interfere with or disrupt the Service or servers connected to the Service
  • Reverse engineer, decompile, or disassemble any part of the Service

3. Account Security

If you create an account, you are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your account information is accurate and up to date

4. Parental Supervision

You acknowledge that WeRead is a tool designed for parents and guardians. You are solely responsible for supervising your child's reading activities and determining which questions and activities are appropriate for your child. We do not provide childcare, educational services, or parenting advice.

D. Intellectual Property

1. Our Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof (collectively, "Content"), are owned by WeRead or our licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The WeRead name, logo, and all related product and service names, design marks, and slogans are trademarks of WeRead. You may not use these marks without our prior written permission.

2. Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, strictly in accordance with these Terms.

You may not:

  • Reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Content without our express written permission
  • Use the Service or Content for any commercial purpose without a separate commercial license
  • Remove or alter any copyright, trademark, or other proprietary notices

3. User-Generated Content

If you provide feedback, suggestions, or other communications to us ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate such Feedback into our Service without compensation or attribution to you.

4. Third-Party Content

Book titles, author names, cover images, and other book metadata accessed through our Service are the property of their respective publishers and authors. We do not claim ownership of this third-party content. Our Service uses this information solely for the purpose of generating reading questions and identifying books for your personal use.

E. AI-Generated Content Disclaimer

WeRead uses artificial intelligence technology to generate reading comprehension questions, vocabulary suggestions, and other educational prompts. You acknowledge and agree to the following:

1. No Guarantee of Accuracy

While we strive to provide high-quality, age-appropriate questions, AI-generated content may occasionally contain errors, inaccuracies, or inappropriate suggestions. We do not guarantee that all generated questions will be factually correct, grammatically perfect, or suitable for every child.

2. Parental Review Required

You are responsible for reviewing all AI-generated questions before using them with your child. You should use your own judgment to determine whether questions are appropriate, accurate, and aligned with your family's values and your child's developmental level.

3. No Substitute for Human Judgment

WeRead is a tool to support, not replace, your parental judgment and involvement in your child's reading development. AI-generated content should be used as a starting point for conversation, not as a definitive educational curriculum.

4. Continuous Improvement

We continuously work to improve our AI models and question quality. By using the Service, you may be asked to provide feedback on question quality, which helps us improve the Service for all users.

5. Third-Party AI Services

Our Service may use third-party AI providers (such as OpenAI) to generate content. These providers have their own terms of service and privacy policies. We are not responsible for the performance, accuracy, or reliability of third-party AI services.

F. No Professional Advice

WeRead provides a reading support tool for parents and guardians. The Service does not provide, and should not be construed as providing, any of the following:

1. Not Educational or Pedagogical Advice

The questions and prompts generated by WeRead are not a substitute for professional educational assessment, curriculum design, or teaching. We do not provide educational advice, learning disability diagnosis, or academic counseling.

2. Not Parenting or Child Development Advice

WeRead does not provide parenting advice, child development guidance, or behavioral recommendations. If you have concerns about your child's development, learning, or well-being, please consult a qualified professional such as a pediatrician, educational psychologist, or licensed therapist.

3. Not Medical or Psychological Advice

The Service does not diagnose, treat, or provide medical or psychological advice regarding reading difficulties, learning disabilities, or any other health conditions. Always seek the advice of qualified health professionals with any questions you may have regarding your child's health or development.

4. No Professional Relationship

Use of the Service does not create a professional relationship (such as teacher-student, therapist-client, or doctor-patient) between you, your child, and WeRead or any of our employees, contractors, or affiliates.

G. Accounts and Termination

1. Account Creation

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use or security breach

2. Subscription and Payment

If you purchase a paid subscription:

  • You authorize us to charge your payment method on a recurring basis until you cancel
  • Subscriptions automatically renew unless you cancel before the renewal date
  • We may change subscription pricing with at least 30 days' notice
  • All fees are non-refundable except as required by law or as explicitly stated in our refund policy
  • You are responsible for any taxes, duties, or fees associated with your purchase

3. Account Termination by You

You may terminate your account at any time by contacting us at support@weread.app. Upon termination, your right to use the Service will immediately cease. We will delete your personal data in accordance with our Privacy Policy, typically within 30 days of your request.

4. Account Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Requests by law enforcement or government agencies
  • Technical or security issues that pose a risk to the Service or other users

5. Effect of Termination

Upon termination of your account, all licenses granted to you under these Terms will immediately terminate. Sections of these Terms that by their nature should survive termination (including but not limited to intellectual property provisions, disclaimers, limitations of liability, and dispute resolution provisions) will survive termination.

H. Limitation of Liability & Disclaimers

1. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will meet your specific requirements or expectations
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • The quality of any questions, content, or information obtained through the Service will meet your expectations
  • Any errors in the Service will be corrected

2. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WEREAD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or use
  • Loss of or damage to property
  • Business interruption
  • Personal injury or emotional distress
  • Educational or developmental setbacks

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

3. Maximum Liability Cap

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) $100 USD.

4. Indemnification

You agree to indemnify, defend, and hold harmless WeRead, its affiliates, and their respective officers, directors, employees, agents, and representatives from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any harm caused to your child or any third party related to your use of the Service

5. Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

I. Third-Party Services and Links

1. Third-Party Integrations

Our Service may integrate with or rely on third-party services, including but not limited to:

  • OpenAI (for AI-generated content)
  • Google Books API (for book metadata)
  • Payment processors (for subscription billing)
  • Analytics providers (for usage tracking)
  • Email service providers (for communications)
  • Cloud hosting and infrastructure providers

2. No Control Over Third Parties

We do not control these third-party services and are not responsible for their availability, accuracy, content, products, services, or practices. Your use of third-party services is governed by their own terms of service and privacy policies.

3. Third-Party Links

The Service may contain links to third-party websites or resources. We provide these links for your convenience only and do not endorse or assume responsibility for the content, accuracy, or practices of these third-party sites.

4. No Warranty for Third-Party Services

We make no warranties or representations regarding third-party services, and we disclaim all liability for any harm or damages arising from your use of third-party services or websites accessed through our Service.

J. Modifications to Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page.

For material changes to these Terms, we will provide notice through one or more of the following methods:

  • Sending an email notification to the address associated with your account
  • Displaying a prominent notice within the Service
  • Posting a notice on our website homepage

Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.

We encourage you to review these Terms periodically to stay informed of any updates.

K. Governing Law and Dispute Resolution

1. Governing Law

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles.

2. Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the courts located in Japan. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

3. Dispute Resolution Process

Before filing any legal claim, you agree to first contact us at support@weread.app to attempt to resolve the dispute informally. We will attempt to resolve disputes through good-faith negotiation within 30 days of receiving your notice.

4. Waiver of Class Actions

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

5. Limitation Period

Any claim or cause of action arising out of or related to your use of the Service or these Terms must be filed within one (1) year after the claim or cause of action arose, or it will be permanently barred.

L. General Provisions and Contact Information

1. Entire Agreement

These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and WeRead regarding the Service and supersede all prior agreements and understandings.

2. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

3. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of WeRead.

4. Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. We may assign these Terms without restriction.

5. Force Majeure

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, natural disasters, labor disputes, or internet service provider failures.
